1. Acceptance of Terms

By accessing or using the Platform, you ("you", "User") agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.

2. Services Overview

Pawbud Health provides:

  • AI Health Scan tools (for pets) that generate informational outputs based on your inputs ("AI Scans").

  • At-home medical test booking (sample collection via third-party labs) and digital report delivery ("Tests").

  • Tele-consultation booking with independent veterinary doctors/clinics ("Tele-consults").

We may add, remove, or modify features from time to time.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract under Indian law. If you are using the Platform on behalf of an entity, you represent you have authority to bind that entity.

4. Important Disclaimers (AI + Medical)

4.1 AI Scans are not medical devices and not diagnostic
AI Scans are for general informational and wellness support only and are not a medical device, not intended for diagnosis, treatment, cure, or prevention of any disease. Always consult a qualified veterinarian for medical decisions.

4.2 Tele-consults and clinic services are provided by independent providers
Veterinary advice, prescriptions (if any), and clinical decisions are made solely by the independent veterinarian/clinic. Pawbud is a technology platform that connects users to independent providers; Pawbud does not practice veterinary medicine and does not control provider decisions.

4.3 Not for emergencies
Do not use the Platform for emergencies. If your pet has an emergency, seek immediate in-person veterinary care.

5. User Account and Responsibilities

You agree to:

  • Provide accurate contact information and pet details.

  • Maintain confidentiality of your login credentials.

  • Use the Platform lawfully and not misuse, reverse engineer, scrape, or disrupt the Platform.

You are responsible for all activity on your account.

6. Booking Rules

6.1 Tele-consults — scheduling, no-show, cancellation

  • Grace period: If you do not join within 15 minutes of the scheduled start time, the appointment may be treated as a no-show.

  • Cancellation/reschedule window: You may cancel or reschedule up to 3 hours before the scheduled start time.

  • Late cancellations/no-shows: Cancellations within 3 hours of start time and no-shows are non-refundable because provider time/slot is reserved.

  • Provider delays: If the provider is late, we will reasonably assist rescheduling or refunding as per this section.

6.2 Tests — third-party labs + seller of record

  • Third-party fulfilment: Sample collection and testing are performed by independent third-party labs.

  • Seller of record: Pawbud will be the seller of record, collect payment, and issue invoices to you; we will share required booking details with the lab to fulfil the service.

  • Cancellation: You may cancel Tests until a lab/partner is assigned. Once assigned, cancellation may not be possible and/or may be non-refundable if costs have been incurred (logistics, allocation, scheduling).

  • After sample collection: Once a sample is collected, the Test is not cancellable and not refundable (except where required by law or if the lab confirms a service failure attributable to the lab).

7. Payments, Pricing, and Taxes

  • Prices are shown on the Platform in INR unless stated otherwise.

  • Payments may be processed via third-party payment gateways (including Razorpay). Pawbud does not store full card details; payment processors handle them per their policies.

  • You authorise us (and our payment partners) to charge your selected payment method.

8. Subscriptions

If you purchase a subscription:

  • Auto-renewal: Subscriptions renew automatically at the billing frequency unless you cancel before the renewal date.

  • How to cancel: You can cancel auto-renewal through your Pawbud account settings (or as otherwise displayed on the Platform). Cancellation stops future renewals; the current billing period remains active unless otherwise stated.

  • Fees and refunds: Subscription fees are typically non-refundable for partial periods unless required by law or explicitly offered in a plan.

9. Refunds

9.1 General principles

  • Refunds, if approved, are issued to the original payment method.

  • Processing time: typically 5–10 business days (bank timelines may vary).

9.2 No cancellation charges principle
We will not impose "cancellation charges" on consumers unless similar charges are also borne by us when we cancel unilaterally, consistent with the Consumer Protection (E-Commerce) Rules, 2020 principle. (Practically: we may treat late cancellations/no-shows as non-refundable rather than charging an extra "fee," and if we cancel, we do not penalize you.)

10. Reports and Information Delivery

Test reports are prepared by third-party labs and may be reformatted by Pawbud for readability. The lab remains responsible for the underlying results.

You should verify critical medical decisions with a veterinarian.

11. User Content (Pet images, videos, messages)

You retain ownership of content you upload ("User Content"), but you grant Pawbud a limited license to host, process, transmit, and display it to operate the Services.

12. Opt-in Use for AI Improvement

If you explicitly opt-in (as presented in-app), you allow Pawbud to use certain uploads and interactions to improve our models and services. If you do not opt in, we will not use your uploads for training/improvement beyond providing the service, security, and compliance needs.

13. Prohibited Conduct

You must not:

  • Use the Platform for unlawful purposes.

  • Upload harmful, abusive, infringing, or misleading content.

  • Interfere with Platform security, scrape data, or attempt unauthorized access.

14. Intellectual Property

The Platform, software, branding, and content (excluding User Content) are owned by Pawbud or licensors and protected by IP laws. You may not copy, modify, distribute, or create derivative works except as allowed by law.

15. Third-Party Services

The Platform may include third-party services (labs, vets, payment processors, analytics/advertising SDKs). Their terms and policies may apply to your use.

16. Limitation of Liability

To the maximum extent permitted by law:

  • Pawbud is not liable for acts/omissions of independent vets, clinics, or labs.

  • Pawbud is not liable for medical outcomes, diagnostic accuracy, or treatment decisions.

  • Indirect or consequential damages are excluded.

  • Total liability, if any, shall not exceed the amount paid by you to Pawbud for the specific service giving rise to the claim in the preceding 3 months (or the minimum required by law, if higher).

17. Indemnity

You agree to indemnify Pawbud for claims arising from your misuse of the Platform, violation of these Terms, or violation of law/third-party rights.

18. Suspension and Termination

We may suspend/terminate access if we reasonably believe you violated these Terms, misused the Platform, or created legal/security risk.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

19.1 Amicable Resolution

If any dispute, controversy, or claim arises out of or in connection with these Terms, the Platform, or the Services (a "Dispute"), the parties shall first attempt to resolve the Dispute amicably by written notice and good-faith discussions for 30 (thirty) days from the date of such notice.

19.2 Arbitration

If the Dispute is not resolved within the period above, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.

  • Seat and Venue: New Delhi, India

  • Language: English

  • Arbitrator: A sole arbitrator jointly appointed by the parties. If the parties do not agree on the arbitrator within 15 (fifteen) days of a request for arbitration, the arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996.

  • Procedure: The arbitration proceedings shall be conducted in such manner as the arbitrator deems fit, consistent with applicable law.

  • Award: The arbitral award shall be final and binding on the parties.

19.3 Interim Relief and Jurisdiction

Nothing in this clause shall prevent either party from seeking interim or injunctive relief from courts of competent jurisdiction. Subject to Section 19.2, the courts at New Delhi shall have exclusive jurisdiction for (i) interim relief, and (ii) matters not capable of being referred to arbitration.

19.4 Class Action / Representative Proceedings Waiver (Optional)

To the extent permitted by applicable law, disputes shall be brought on an individual basis only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

We will acknowledge complaints within 24 hours and aim to resolve within 15 days (or earlier where feasible).

21. Changes to Terms

We may update these Terms. Continued use after updates means you accept the revised Terms.
